PREMISES The offer and sale of products on the website www.glowdonna.it are governed by the following general conditions of sale. The products purchased on the site are sold by GLOW SRLS VAT number 10369091219 – Via Santa Maria del Pozzo, 166 80049 Somma Vesuviana (NA) DEFINITIONS The following definitions are used in this contract: Customer: indicates the natural person who purchases the products for purposes other than any entrepreneurial, commercial, artisanal or professional activity carried out; GLOW DONNA: indicates the company GLOW SRLS VAT number 10369091219 – Via Santa Maria del Pozzo, 166 80049 Somma Vesuviana (NA) Products: indicates the products marketed by GLOW DONNA; Party: indicates the customer or GLOW DONNA severally; Parties: indicates the customer and GLOW DONNA jointly. KNOWLEDGE OF THE GENERAL TERMS AND CONDITIONS OF SALE. The customer is deemed to have read and understood the terms and conditions of sale at the time of purchase. Therefore, each order implies implicit acceptance. These general terms and conditions may be updated or modified at any time by GLOW DONNA, which will provide notice of such changes through the appropriate customer communication channels. OBJECT OF THE CONTRACT: The offer and sale of products on the website www.glowdonna.it imply the implementation of a distance contract governed by Articles 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (Consumer Code), as well as Legislative Decree no. 70 of 9 April 2003 (the so-called law on electronic commerce). The purchase of products is intended for private consumers only. ACCEPTANCE OF THE ORDER AND CONCLUSION OF THE SALES CONTRACT By submitting a purchase order, the customer declares that they understand and accept these conditions of sale and the additional information contained on the site. The contract will be considered concluded, and will be binding on both parties, only when the customer receives notification of shipment via email to the email address provided at the time of purchase. PRODUCTS AND SALES PRICES All product prices on the website www.glowdonna.it include VAT and any other taxes. They constitute an offer to the public pursuant to art. 1336 of the Italian Civil Code. It is understood that the image accompanying the product presentation may not be perfectly representative of its characteristics but may differ in color, size, and accessory products shown in the image. PAYMENT METHODS The PayPal and Stripe platforms directly manage the data entered on their website to process the payment. GLOW DONNA does not collect any data relating to the credit card used, or relating to the access codes for the "Paypal" or Stripe payment method. This information is collected directly from the PayPal or Stripe payment systems. You can pay by cash on delivery or bank transfer. TAX CERTIFICATION AND INVOICE Invoices for products purchased by private individuals are not issued as these sales transactions are not subject to the obligation of tax certification pursuant to Article 22, paragraph 1, no. 1 of Presidential Decree 633 of 1972 and Article 2 of Presidential Decree 696 of 1996. All customers are sent an order summary that has the same fiscal and legal value as a traditional receipt. PROVISION AND PROCESSING OF PERSONAL DATA Customer personal data is collected for the purpose of fulfilling the purchase contract and shipping the orders received. This data is processed electronically in compliance with applicable laws and may be disclosed only upon request by judicial authorities or other legally authorized authorities. Personal data will be communicated to parties delegated to carry out the activities necessary for the execution of the stipulated contract and disclosed exclusively for this purpose. The customer expressly undertakes to provide GLOW DONNA with copies of identity documents deemed necessary for any verification purposes. Failure to comply with the aforementioned request authorizes GLOW DONNA to immediately terminate the contract for breach. Processing will be carried out, including with the aid of electronic means, in compliance with the procedures established by Article 11 of Legislative Decree No. 196 of June 30, 2003, to guarantee the user and, in general, to protect their rights, fundamental freedoms, and dignity, with particular reference to privacy and personal identity. Processing will be carried out for a period of time no longer than strictly necessary to fulfill the aforementioned purposes. DELIVERY METHODS AND TIMES The products are shipped by express courier, and delivery times to the customer vary depending on the destination, the time the order is acquired and the availability of the product itself. In any case, delivery times will never exceed those set forth in Article 6 of Legislative Decree 185/99. For in-stock goods, delivery to the courier occurs within 2 business days from the time the order confirmation is sent to the customer. Barring unforeseen circumstances, delivery times within Italy will be 2 business days from delivery to the courier. For Puglia, Basilicata, Calabria, Sicily, and Sardinia, delivery times will generally be 3 business days. For hard-to-reach locations such as mountainous areas, smaller islands, and remote outskirts, delivery times will be 3-4 business days. Upon receipt of the goods, the customer must strictly verify that the package is perfectly closed, intact, and undamaged. Each package is secured with adhesive tape to prevent opening and to flag any tampering attempts if the tape is damaged. If the warranty tape is damaged, the customer must immediately report the matter to the courier, accepting the package with specific reservations, indicating where and how the damage occurred. Otherwise, the package will be deemed to have been properly delivered. If the customer is unavailable at the time of delivery, the courier will leave a note. A second delivery attempt will be made the following day. If the order is still unable to be delivered, the customer must contact the courier as soon as possible to arrange delivery, within a maximum of 2 business days. To ensure smooth delivery, the customer is required to include a mobile phone number in the delivery information. RIGHT OF WITHDRAWAL Pursuant to and for the purposes of the Consumer Code, as amended by Legislative Decree no. 21/2014, the Customer is entitled to exercise the right of withdrawal, without penalty and without specifying the reason, within 14 calendar days from the date of delivery of the purchased item. To exercise this right, the customer must send, within the indicated timeframe, an email to info@glowdonna.it indicating: subject of the request (REFUND – ITEM EXCHANGE), Name, Surname, Address, Order Number, Telephone Number. As soon as this communication is sent, the Customer must ship, at their own expense and using a courier of their choice, the product they intend to return, including the order summary received and the receipt in the shipment. Once the returned product has been received, GLOW DONNA will proceed with: REFUND: via direct refund via PayPal, Stripe, or Klarna. Or via bank transfer in the case of cash on delivery. The refund will be made within 14 days of GLOW DONNA receiving the product. The refund will include the cost of the returned product and will not include shipping costs. Return shipping is always the customer's responsibility. ITEM EXCHANGE: Once the product arrives at the warehouse, the exchange will be sent; reshipping costs are the customer's responsibility. In this case, the email and the related printout must specify that you wish to exchange the item and the desired item. The customer will be held responsible, and therefore not liable for compensation, for any diminished value of the goods resulting from handling other than what is strictly necessary to establish the nature and characteristics of the item. All risks related to the transport of the returned product are borne by the customer. Return shipping is always the customer's responsibility. Reshipping is always the customer's responsibility.
